Use of the Site or any EPL Systems following posting of such changes constitutes your acceptance of the revised Policy then in effect.
Location of the Site. The Site and all EPL Systems are owned and operated by EPL from the United States of America. If you are visiting this Site from a country other than the country in which EPL’s servers are located, your communications with us may result in the transfer of information across international boundaries. By visiting this Site and communicating electronically with us, you consent to such transfers.
Information Collection and Use. EPL receives and may store any information you enter on our Site or through any EPL Systems or provide to us in any other way (for example, through email). In addition to information you input or otherwise provide to us, we also collect other information, as described in this Policy, as you visit or interact with our Site and any EPL Systems.
We will collect your information when you provide it to us for any purpose and when our systems collect the information through technological means, as described in this Policy. We will use that information (i) to further the purposes for which you submitted the information to us, (ii) to allow you to establish an online account with us, (iii) to notify you of important information, or to seek additional information from you, related to any account you have with, or services or products you are receiving or requesting from EPL or any of its affiliates, (iv) to notify any EPL affiliates, or process any work requests, instructions or other information submitted by you, in connection with any services or products you are receiving or requesting from EPL or its affiliates, (v) to allow EPL affiliates to do any of the foregoing (and we will share your personal information with our affiliates for such purposes), (vi) for our internal business purposes, such as data analysis, audits, enhancing our Site or the EPL Systems, improving the services or products offered by EPL or its affiliates, and identifying usage trends, and (vii) as otherwise permitted in this Policy.
We may use your personal information to let you know about general updates concerning EPL or its affiliates, to let you know about services or products available through EPL, its affiliates, or any of their business partners, and to otherwise keep you informed of matters we believe will be of interest to you. If you do not wish to receive the types of communications described in the immediately preceding sentence, you may “opt-out” by contacting us as provided in the “Contacting Us” provisions at the end of this Policy. Please understand, however, that certain communications may concern or otherwise affect an account you have with EPL or its affiliates, and you will not be able to opt-out of receiving those communications.
We may also require or permit you to submit credit card or other payment information, or other financial information, in connection with any fees we may charge for your use of the Site or any EPL Systems, or in connection with any services or products you request or are receiving from EPL or any of its affiliates (in which case we may share such financial information with our affiliates).
In addition to the information you input or otherwise submit or transmit to us, when you visit or interact with the Site or the EPL Systems, we may collect information from you through various technological means. Some examples are:
Server Log Files and IP Addresses – We identify and log your Internet Protocol (IP) address (a unique number that is automatically assigned to the computer you are using) in our server log files whenever you visit the Site or any EPL Systems, along with the time(s) of your visit(s) and the page(s) that you visited. We use your IP address, and the IP addresses of all users, for purposes such as calculating Site or EPL Systems usage levels, helping diagnose problems with our servers, and administering the Site and the EPL Systems.
Environmental Variables – We may also collect certain device or environmental variables, such as your MAC address, computer type (Windows or Macintosh), screen resolution, OS version, Internet browser, and Internet browser version. We use this information to, among other things, help us better interact with you during your visits and to otherwise stay informed about the manner in which our visitors are accessing the Site and any EPL Systems.
Pixel Tags – We may also use so-called “pixel tags”, “web beacons”, “clear GIFs” or similar means (collectively, “Pixel Tags“) in connection with some web pages and HTML formatted e-mail messages to, among other things, compile aggregate statistics about usage and response rates. A Pixel Tag is an electronic image that is ordinarily not visible to Site visitors and may be associated with Cookies on the visitors’ hard drives. Pixel Tags allow us to count users who have visited certain pages of the Site or the EPL Systems, to deliver branded services or products, and to help determine the effectiveness of promotional or advertising campaigns. When used in HTML formatted e-mail messages, Pixel Tags can tell the sender whether and when the e-mail has been opened.
While the information collected through the technological means described above is generally not personally identifiable (meaning it does not identify you personally), we may combine personally identifiable information with other types of information we collect from you, and in such a cases, we will treat that combined information as personally identifiable information under this Policy. We may aggregate information we collect, and use such aggregated information for internal purposes to stay informed about the users who are visiting or using the Site or any EPL Systems (for example, we may use collected information to calculate the percentage of our users who have a particular telephone area code). Additionally, we may share with any other party, and use for any purpose, any such aggregated information, or other information, that does not personally identify you.
Third-party Service Providers. EPL works with third-parties who provide services including, but not limited to, data analysis, website hosting, credit card processing, email services, conducting surveys, and other services related to the Site or the EPL Systems. Your personal and financial information (as well as other types of information) may be collected by or shared with such third-parties for the purpose of enabling these third-parties to provide such services, and in some cases your information may be retained or used by such third-parties. Additionally, such third-parties may use one or more of the technological means described above to collect information. We will make commercially reasonable efforts to prohibit, through contractual requirements, these third-parties from using your personal or financial information for any purpose other than fulfilling their obligations to EPL, but we cannot guarantee that such third-parties will not use your information for other purposes.
Assignment or Sale. We may transfer any and all information that we collect from you to a third-party in the event of any reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of EPL business, assets or stock (including without limitation in connection with any bankruptcy or similar proceedings).
Security. We have certain security measures and tools, such as firewalls, in place to help protect against the loss, misuse and alteration of the information under our control. Unfortunately, no data transmission over the Internet or data storage system can be guaranteed to be 100% secure. As a result, although we strive to protect your information, we cannot ensure or warrant the security of any information you transmit to us through or in connection with the Site or any EPL Systems or that is stored by us. If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of any account you might have with us has been compromised), you must immediately notify us of the problem by contacting us in accordance with the “Contacting Us” provisions described below (note that if you choose to notify us via physical mail, this will delay the time it takes for us to respond to the problem).
